Composition of the Constitutional Court

Structure of the Court and Judicial Independence

• The Constitutional Court will consist of 11 judges, an odd number intended to ensure that decisions can be reached.
• The Court is the guardian of Yehodaya’s Constitution and Bill of Rights.
• To guarantee its complete independence from political pressure, organized interests, or academic agendas, judges will be selected exclusively on the basis of objective intellectual excellence and direct election by the sovereign - the people.
• Search committees, the Sanhedrin, and the President will have no role in selecting Constitutional Court judges.
• A Constitutional Court judge will serve one continuous, non-renewable term of nine years.

Eligibility to Stand for Election

Any citizen of Yehodaya may seek election to the Constitutional Court, provided that the citizen satisfies the following conditions on the date of registration:

• The candidate is over 40 years old.
• The candidate holds a recognized academic degree in law or economics.
• The candidate has an entirely clean criminal record.
• The candidate has publicly signed an originalist declaration requiring the Constitution and the Bill of Rights to be interpreted according to their text and plain meaning, without reading into them meanings that are not expressly stated and without creating positive rights at the expense of individual liberty.
