Foundations of the Constitution

The Second Constitutional Tier

The full Constitution shall be drafted by Yehodaya’s Founding Council.

The Constitution shall remain subordinate to the Bill of Rights of the State of Yehodaya. The Bill of Rights constitutes the supreme tier of law in Yehodaya, and any constitutional provision that conflicts with it shall be null and void.

Principles of Governance and Sovereignty

  • The People Are Sovereign: Popular sovereignty shall be exercised through the direct election of the President, members of the Sanhedrin, judges of the Constitutional Court, and the Auditor of the Constitutional Court; through the approval of constitutional amendments by referendum; and through referendums on matters of national importance.
  • Separation of Powers: The state shall operate under a system of checks and balances comprising a legislative branch—the Sanhedrin; an executive branch—the President and government; an independent judicial branch—the Constitutional Court and ordinary courts; and an independent oversight branch.
